The Land Bank is a special agency mandated by the Job Creation Law, specifically authorized to manage land. The assets of the Land Bank are separate from state assets, with the mission of ensuring land availability for public interest, social interest, national development, economic equity, land consolidation, and agrarian reform. Specifically, the authority for land management and utilization by the Land Bank is regulated under Government Regulation No. 64 of 2021 on the Land Bank Agency.
Land Acquisition by the Land Bank
The Land Bank acquires land through the determination of the government and other sources, which is then granted under management rights under the name of the Land Bank.
Land Management by the Land Bank
The management of land by the Land Bank is carried out through:
(i) land development,
(ii) land maintenance and security, and
(iii) land control.
- Land Development
Land development activities are carried out by preparing land for the construction of infrastructure facilities in industrial zones, tourism areas, agriculture, plantations, special economic zones, and other economic areas, including: housing and residential areas; urban renewal; development of integrated areas; land consolidation; infrastructure development; construction of facilities and utilities; land preparation; and national strategic projects. This development is implemented based on the local spatial plan and may involve cooperation between the central government, local government, and other parties. - Land Maintenance and Security
Land maintenance and security activities are conducted to preserve and protect the land, covering both legal and physical aspects. - Land Control
Land control activities are carried out to regulate land ownership, utilization, and value.
Land Utilization by the Land Bank
The Land Bank authorizes the use of land with other parties through utilization cooperation, with the scheme: sale and purchase; lease; business cooperation; grant; exchange; and other agreed forms. The Land Bank will provide assistance in the sector of land and spatial planning as a form of facilitating business licensing. The Head of the Land Bank Implementing Agency will determine the land utilization fees for the implementation of cooperation in land usage. The fee determination considers at least the fee amount, duration, and payment procedures.
