AFS Chambers Prevails at the Case Review Stage: Cassation Judgment Annulled, Claim Declared Inadmissible

Jakarta, 30 March 2026 – AFS Chambers has secured another significant victory in a high-stakes civil dispute involving the transfer of land and building rights in South Jakarta. The case began with a lawsuit seeking to nullify the transfer of rights over a plot of land and house, and to void the registered certificate holder of AFS Chambers’ client.

At the first stage, the South Jakarta District Court declared the civil claim inadmissible due to lack of jurisdiction. The Jakarta High Court, however, overturned that ruling and held that the dispute was a civil case, thus falling under the authority of the public court. The Supreme Court affirmed this appellate decision at the cassation stage.

AFS Chambers subsequently filed a Case Review on the basis of fundamental judicial oversight at the cassation stage regarding absolute competence. The Panel of Judges ultimately accepted AFS Chambers’ reasoning, affirming that the matter squarely falls under the administrative court’s jurisdiction. Consequently, the civil claim was declared inadmissible.

This outcome reaffirms AFS Chambers’ commitment to precise legal reasoning and procedural discipline, especially in matters involving absolute jurisdiction.
