AFS Chambers Successfully Represents PT Triniti Menara Serpong in Construction Dispute before the District Court of Tangerang

Jakarta, 23 November 2025 – AFS Chambers successfully advised and represented PT Triniti Menara Serpong (“PT TMS”) in a breach-of-contract claim filed by its contractor before the District Court of Tangerang. The dispute originated from internal issues between the contractor and its subcontractor, which ultimately resulted in claims being submitted to PT TMS.

The core issue arose when the contractor appointed by PT TMS delegated almost the entire scope of work to its subcontractor without notifying PT TMS. At the end of the project, disagreements emerged between the contractor and subcontractor regarding payment amounts. Due to the absence of mutual agreement, both parties submitted their respective payment demands to PT TMS. PT TMS emphasized that the company was fully willing to fulfill its payment obligations, provided that the contractor and subcontractor first reached an agreement on the allocation of payments between them. Instead of resolving their internal dispute, the contractor chose to file a breach-of-contract lawsuit against PT TMS before the District Court of Tangerang.

During the proceedings, PT TMS stated that it could not accept the contractor’s settlement proposal. This position was based on the arbitration jurisdiction issue arising from the arbitration clause within the contract. PT TMS further asserted that any settlement could only be considered valid if agreed upon and signed by all three parties, namely PT TMS, the contractor, and the subcontractor, and included a clear agreement regarding each party’s respective payment obligations. This stance was taken to ensure that the resolution would fully conclude the dispute and eliminate the risk of future claims.

Through intensive and constructive negotiations, the matter was ultimately resolved amicably. The parties successfully reached a joint settlement, leading to the contractor’s formal withdrawal of its breach-of-contract lawsuit from the District Court of Tangerang.

The settlement process was led directly by Managing Partner of AFS Chambers, Adrian Fernando. He emphasized that in dispute resolution practice, a comprehensive and well-structured settlement holds a higher value and principle than merely winning a case in court.
